Digital Stamp Terms and Conditions

TERMS & CONDITIONS
 

These terms and conditions (the “Terms”) form a legal agreement between you or your company / organisation (“You”) or the Customer and An Post, located at the GPO, O’Connell Street, Dublin 1 (“we” or “us”) that governs your purchase and use of the Service.  For the purposes of these Terms, the “Services” means the service comprising the purchase of a Digital Stamp allowing You to prepay the postage for sending:

  • When sending within Ireland. Letters and Large Envelopes only, for which you will receive notification of Delivery (An Post Notified service); or

  • When sending abroad, Letters and Postcards only, by international post, for which you will receive digital notification that your Item has been accepted for transmission by post, but will not receive notification of delivery to an international destination

And reference to a Service is a reference to either one of the Services. 

Neither Packets nor Parcels can be sent using the Digital Stamp, either in Ireland or abroad

Only Letters and Large envelops can be sent within Ireland. Only Letters and Postcards can be sent abroad using the Digital Stamp. Please see further below the limitations and requirements that apply to the Services.

By using the Service, You are agreeing to comply strictly with these Terms and other documents incorporated under Clause 13. 
The term “You” for purposes of these Terms, means you acting in Your personal capacity only. 

 
PLEASE NOTE:
  • The rights to use the Service are personal to You and are not transferrable.  The Service may not be used by or on behalf of any third party.This Service is available to buy on the An Post App only.

  • The Digital Stamp is valid for sending Your Items for 6 (six) months from date of purchase. It may be used to send Items by Notified only and is not valid for use with any other An Post postal service.

  • Once payment is complete and the Digital Stamp(s) have been sent to the email address You provide, Your Digital Stamp purchase cannot be cancelled and is not refundable.

  • Paper stamps may not be added to make up postage for other services.

  • The Service does not provide insurance or tracking - it should not be confused with An Post Registered post service.
     

  • The Services are subject to the limitations contained in CLAUSES 2 AND 3.  An Post will not be liable to pay compensation in all circumstances. Not all items are acceptable for posting. PLEASE READ CLAUSE 8 AND CLAUSE 12 AND THE REST OF THESE TERMS CAREFULLY. 
  • Sending Items is subject to the Communications Regulation (Postal Services) Act 2011.  

1. DEFINITIONS

In these Terms:
The “2011 Act” means the Communications Regulation (Postal Services) Act 2011, as amended;
App” means the An Post App or other App operated on behalf of An Post that enables You to purchase Digital Stamp(s);
Charge” means the charge for the Digital Stamp appropriate to the size and weight of Your Item and which is set out on the App for Your purchase prior to payment;
Digital Stamp” means the An Post Digital Stamp which You can purchase via the App and comprises the 12 digit alphanumeric code to indicate Your prepayment of postage on an Item;
certificate of posting” means a receipt issued in respect of a Letter or Large postal packet deposited at an access point for transmission by universal postal service;
Content” means all content, material and other information made available on or through the Service;
Data Protection Legislation” means the Data Protection Act 2018 and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”);
Delivery” means delivery of Your Item at the address written by You on the front of the Item; it shall not mean hand delivery to the addressee or a signed for delivery;
Delivery Notification” means the notification of Delivery sent to You in the manner chosen by You prior to Your purchase of the Digital Stamp;
FAQ” means the “Frequently Asked Questions” section related to the Service [on the App];
General Terms” means the General Conditions numbered 1 – 12 only contained in the An Post Terms and Conditions for USO Single Piece Services as found on https://www.anpost.com/Terms-Conditions;
Item” means a Letter or Large Envelope when sending within Ireland and a Letter or postcard only when sending abroad, in either case, the content of which is not a Prohibited Item and which is within the size and weight limits specified at https://www.anpost.com/Post-Parcels/Sending/Sending-Guide and is packed to the required standard (for advice on packing see www.anpost.com/Post-Parcels/Sending/Sending-Guide) and Items shall be construed accordingly.
Notified” means the An Post postal service for sending Items prepaid by a Digital Stamp within Ireland only, providing a Delivery Notification subject to these Terms and having a target delivery time of 1 (one) Working Day after day of sending;
Prohibited Items” means the products listed at https://www.anpost.com/Post-Parcels/Sending/Sending-Guide/Prohibited-Items
Restrictions on Use” means the restrictions on your use of the App as set out in the App Terms of Use
 “Transaction” means each payment for a Digital Stamp as prepayment of postage of an Item You wish to send by Notified service and for which You may provide Your contact details to receive Delivery Notification;
Working Day” means any day between the hours of 9.00 hours and 17.00 hours which is not a Saturday, Sunday, bank holiday, public holiday or An Post non-service day

 
2. THE SERVICES

In order to use the Service, You must:

  • download the An Post App

  • ​verify your email address with Us

  • select your item type – Letter or Large Envelope for domestic or Letter or Postcard only for international;

  • pay the appropriate Charge for the Service as displayed in the App.

Once you have completed a Transaction, you will receive the Digital Stamp. 
The use of all postage stamps, including any postal prepayment impressions or other stamping process such as the Digital Stamp; is  subject to the rules of the UPU Acts and other postal legislation.  Usage is subject to the authorization of An Post.
A Digital Stamp may only be used once. This means that You may not write the same alphanumeric code on more than 1 (one) Item.  Doing so would be in breach of the Post and Telecommunications Act 1983 and the Criminal Justice (Theft and Fraud Offences) Act, 2001.
You are responsible for ensuring that the correct value Digital Stamp is used for Your Item, i.e., the correct value for either a Letter or a Large Envelope being sent in Ireland or a Letter or Postcard being sent abroad. No credit or refund will be made if a Digital Stamp of greater value than that required for your Item is purchased.
You must write the Digital Stamp in the top right hand corner only of an Item and in the manner specified by An Post and as shown in the “How to use your Stamp” section of the App at time of purchase.  If a Digital Stamp is not added in the specified manner, a Delivery and Delivery Notification may not be possible.

You are advised to include a sender address on the top left hand corner on the front of the Item – failure to do so may result in the Item being disposed of where Delivery cannot be achieved.
To send an Item with a Digital Stamp, You must submit the Item for posting by depositing it in an An Post Post Box or at a Post Office within 6 (six) months of the date of purchase of the Digital Stamp. 
SENDING IN IRELAND
An Post aims to deliver Notified Items within Ireland the next Working Day after it has been posted.  Next day Delivery of Your item is not guaranteed.  PLEASE ALSO NOTE LAST TIMES OF POSTING APPLY AND WILL AFFECT DELIVERY TIME OF YOUR ITEM.
 
You will receive a Notification of Delivery to the email address You have provided within 1 (one) Working day of Delivery of Your Item.  If you have provided the appropriate contact details, the optional Notification of Delivery will also be sent to You by SMS or push notification..
 
SENDING ABROAD
An Post aims to deliver Items sent abroad within ten (10) Working Days.  However, this is not guaranteed - when sending Items abroad, the post in the destination country will be responsible for completing delivery and not An Post.
 
If you have provided the appropriate contact details, You will receive a notification within 1 (one) Working day of acceptance of Your Item for transmission by post by An Post.  A notification of delivery in the destination country is not provided.

An Post aims to deliver Notified Items the next Working Day after it has been posted.  Next day Delivery of Your item is not guaranteed.  PLEASE ALSO NOTE LAST TIMES OF POSTING APPLY AND WILL AFFECT DELIVERY TIME OF YOUR ITEM.
You will receive a Notification of Delivery to the email address You have provided within 1 (one) Working day of Delivery of Your Item.  If you have provided the appropriate contact details, the optional Notification of Delivery will also be sent to You by SMS or push notification. 
Once you submit an Item for posting, it will be in transmission by post and will be subject to the provisions of the 2011 Act.  This means that an Item a shall be deemed to be in the course of transmission by post from the time of its being presented for posting at an An Post post box or post office to the time of its being delivered to the address You have written on the front of Your Item and the Item sent cannot be withdrawn, retrieved or redirected.  Digital Stamps must otherwise be used subject to the General Terms, in particular in respect of Packing and Endorsements. Please note that sending of Items by post may be interrupted from time to time due to unforeseen circumstances or for reasons outside of An Post’s control.  An Post endeavours to bring this to Your attention as soon as reasonably possible.  We recommend that you access and review the App regularly in order to ensure that you are aware of any service updates or interruptions to An Post postal services.

 
3. LIMITATIONS ON PURCHASE

The Service is not available to buy in Post Offices. 
 
Items may be posted in An Post post boxes or post offices.
 
The maximum purchase of Digital Stamps you may make is € 200 per Transaction.
 
Where delivery of an item using the Services has failed,  the price of the Digital Stamp for that Item may be reimbursed.
 
The Services are not tracked services and should not be used for valuables.  Subject to Clause 12, compensation is not offered  for loss or damage of contents.  
 
The terms of compensation payable by An Post are set out in Clause 12.
 
The Service does not provide for the provision of a certificate of posting, even if Your Item is deposited for posting at a Post Office.

 
4. INFORMATION ABOUT YOU AND YOUR DATA

We process personal information about you in accordance with the An Post Privacy Statement and An Post.ie Cookie Policy.  Further information about how Personal Data is used is set out in An Post Group Privacy Statement at https://www.anpost.com/Privacy/An-Post-Group-Privacy-Statement and the An Post Data Protection mails Notice https://www.anpost.com/Privacy/Data-Protection-Privacy-Notice
Please review these documents so that you understand how we process personal data. 

We will use any personal data provided to us by You to:

  • provide the Service; including the Delivery Notification; 

  • process your payment for the Transactions;

  • contact you, when necessary for us to do so, in case of insufficient payment of Charges or handling (including return) of items which we may be unable to process for the reasons set out Clause 8;

  • to enable us to request You to complete a survey;

  • To manage our relationship with You including notifying You of changes to the An Post App or the Service.

You hereby consent to us retaining your Transaction history to enable You to receive the Delivery Notification.  Personal Data shall not be retained longer than reasonably necessary by An Post and in any event, not longer than the period for which Your Digital Stamps have not expired.
By agreeing to these Terms, You consent to such processing and you warrant and agree that all personal information provided by You is truthful, accurate and complete and that You are providing Your personal data or that of any other party in compliance with Data Protection Legislation.

 
5. PURCHASE OF DIGITAL STAMPS

If you agree to these Terms, You are asked to tick the box in order to confirm your agreement to the Terms and to proceeding to payment for the Service.  By proceeding to payment, you acknowledge that Digital Stamp(s) will be sent to the email address provided by You and your purchase may not be cancelled on receipt of the Digital Stamp(s). 
 
You may submit an order for a Digital Stamp by choosing to PAY at the end of your journey on the App. At time of authorisation of payment, the purchase of the Service is deemed to be complete and a legally binding agreement will have been formed between us and You.  Provided your email address is correct, We will send you a confirmation by email with your purchase of Digital Stamp(s).
 
Where any payment you make for any Digital Stamp is not authorised We will not be obliged to provide any of the services you were seeking to order via the App.


6. PAYMENT OF CHARGES

The Charge will be our stated prices at the time when the You purchase the Digital Stamp is accepted.  Charges may be subject to change from time to time with reasonable prior notice. We recommended that you access the An Post App or anpost.com/digitalstamp regularly in order to ensure that you are aware of the most up to date Charges.
To make a payment, You must follow the instructions on the App and make the payment using one of the payment options provided in the App. Payment for an order should be made immediately, in full, at the time you place your order with us on the App.

 
7. NO CANCELLATION OR REFUNDS

Once payment has been completed and the Digital Stamp(s) have been sent to the correct email address, You may not cancel your purchase of a Digital Stamp and the price paid will not be refundable.
Your Digital Stamp(s) will remain valid for use with the Notified Service for 6 (six) months from the date of purchase.

 
8. DISCRETION TO REFUSE ITEMS FOR POSTING

We may not be able to complete a posting in the following circumstances:

  • the Digital Stamp on the Item is obscured, defaced, incomplete or otherwise unreadable or invalid;

  • the incorrect payment has been made for a Digital Stamp so that the value of the Digital Stamp does not correspond to the Letter or Large Envelope You try to send;

  • any information You have provided relating to an Item is incorrect;

  • the Digital Stamp on the Item is a duplicate of a Digital Stamp that has already been used on another Item;

  • the Digital Stamp is not positioned in the top right hand corner on the front of the Item;

  • The Item contains Prohibited Items; or

  • We are unable to gain access to provide a Delivery Notification.

 
9. RIGHTS TO USE THE SERVICES

You must not:

  • use a Service on behalf of any person other than Yourself, or dishonestly access any other person’s accounts or products using the App;send, knowingly receive, upload, download, use or re-use any virus, malware, malicious code or any material which does not comply with these Terms;

  • interfere with, damage or disrupt any part of the App or any product or any network or equipment used in the provision of the Service or any product; or

  • copy, adapt, reverse engineer, decompile, disassemble, modify, adapt or make error corrections to the App in whole or in part.

You agree that all intellectual property rights relating to the Services remain the property of An Post and You agree that You shall not copy, modify or adapt the Digital Stamp or any part of the Services or App in any way.
In accordance with these Terms, You have the limited right to access the App for the purposes of the Services only and use of the Digital Stamp provided all copyright, trademark and other proprietary notices are left intact.  Copies made incidentally in the ordinary course of Your use of the App (such as in cache memory) are permitted, provided You do not delete or change any copyright, trademark or other notice.  You are prohibited from copying, reproducing or using, in any other way whatsoever, any part or all of the Intellectual Property.

 
10. YOUR LIABILITY TO US

By using the Service(s), You are agreeing to comply strictly with these Terms.  If You do not comply with these Terms, and we suffer losses or incur costs, we can claim these back from You.  We may also terminate Your right to use the Service, as set out in the Term and Termination section below. 

 
11. TERM AND TERMINATION

These Terms will continue to apply for as long as You use the Service(s).
Except in circumstances which are force majeure events and outside the control of An Post, An Post will not terminate Your right to use the Service before the six (6) month expiry period of your Digital Stamp(s). 
However, We reserve the right to terminate this agreement or suspend Your use of the App without any liability or notice:

  • if You materially breach these Terms; or

  • if we reasonably believe that the Service is being or has been used by You in a manner which is negligent, illegal, fraudulent; or

  • for other inappropriate purpose, including where such actions are by a third party as a result of Your negligence or recklessness;

  • or we are required to do so by law or regulation.

We reserve the right to process or cancel any Transactions which are in progress on such termination and / or suspension of Your use of the Service.

 
12. COMPENSATION AND LIMITATION OF LIABILITY

An Post endeavours to provide the Services as described in these Terms.  We may be liable to pay compensation where there is a failure to do so.  However, An Post will not be liable to pay compensation in all circumstances.  Evidence will be required.
 
AN POST WILL NOT BE LIABLE:

  • if you are not a consumer, for any loss of profits, sales, business, or revenue; or business interruption or loss of business opportunity, goodwill or reputation; or any other indirect or consequential loss or damage
  • for any loss that is not foreseeable, loss is not foreseeable if it is not contemplated by both You and by An Post at time of purchase of the Service;
  • for any loss that is a result of Your failure to comply with these Terms; including where an Item may have been sent contrary to the provisions of Clause 8;
  • any loss arising out of the nature or value of the content of an Item and loss which is over and above and wholly distinct from the actual value of the contents of the Item.

 
COMPENSATION
Compensation will not be payable for a delay in delivery of either Letters or Large Envelopes or Postcards unless the Item was substantially delayed (meaning it was not delivered within 5 Working Days after day of posting).  Compensation will not exceed the cost of postage of the Item.
 
Compensation in respect of loss or damage to Letters will not exceed the cost of postage paid for the Letter.
 
If compensation is sought in respect of loss or damage to a Large Envelope containing goods, You need to provide evidence  to support a reasonable claim of loss actually suffered.  A claim is subject to the terms of this Clause 12. Compensation may be payable in an amount equal to the lower of (i) the value of the contents and (ii) €25.

13. DOCUMENTS INCORPORATED BY REFERENCE

These Terms together with any terms, conditions and notices contained on, or which are accessible from, the App including without limitation, the App Terms and Conditions.  The anpost.com Privacy Statement, and the anpost.com Cookie Policy all apply to your use of the Service,  the posting of Your Item as well as Your use of the App.

 
14. CHANGES TO THE SERVICE

An Post may need to change the Service to reflect changes in law, best practice or necessary changes in the functionality of the App or the Service.  Reasonable notice of any material changes to these Terms will be provided on our website .  The current, up to date version of these Terms will be available in the App and at https://anpost.com/termsandconditions .  If we notify You of a change, and You continue to use the Service, We will assume that You have agreed to the changes. If You do not agree with any of the notified changes, You should stop using the Service and close the App from Your device. 

 
15. CUSTOMER QUERIES AND COMPLAINTS 

It is recommended that the first point of contact for any queries or complaints You may have in connection with the Service is our online Live Chat facility.  You can contact An Post via the link to anpost.com to use our Live Chat/Oscarbot facility.

An Post will endeavour to reply to You as soon as reasonably possible and in any event within 5 Working Days. 
An Post will endeavour to conclude your complaint within 45 days of receipt.
If you are not happy with the initial handling of your complaint, you may escalate it by making a submission in writing to the An Post Customer Advocate at the following address within 30 days of the date of the initial An Post Customer Service decision:

 
16. OTHER LEGAL PROVISIONS

If a court decides that we cannot rely on any of these Terms, for any reason, that provision will not apply to the extent decided by the court.  The rest of these Terms will continue to apply.  An Post may decide to transfers its rights and obligations under these Terms to another organisation.  We will let You know if that happens, and will ensure that Your rights under these Terms are protected as required by applicable law. 
Irish law applies to these Terms, and any dispute will be subject to the decision of the Irish courts.

 
17. NOTICES

Any notices under these Terms that you send to us must be in writing. 
We may need to change these Terms from time to time to reflect changes in law, best practice or necessary changes in the Service.  Reasonable notice of any material changes to the Service Terms will be provided on our website at https://anpost.com/termsandconditions
